After McKenna moved to New York to attend Columbia University in October 2012, Miller sued for custody of the then-fetus. A San Diego court ruled that McKenna had been "irresponsible" for leaving California while pregnant. In May 2013, McKenna was forced to relinquish her four-month-old son to Miller and his then-girlfriend, who renamed the infant "Nathaniel." In November 2013, a New York court overturned the previous ruling, noting that "putative fathers have neither the right nor the ability to restrict a pregnant woman from her constitutionally protected liberty" to travel across state lines.
